Public Work Project Fee Increases
Since 1995 the City of Brentwood has levied a Public Works Project Fee (PWPF), also known as the road impact fee on new development. The PWPF is established by Article XI of the Municipal Code and is “based upon trip generation information, trip lengths, vehicle-miles of capacity on the existing major road network, public works project cost estimates, and any applicable fee credits related to existing road related debt payments and state or federal funding.” The one-time fee is assessed when a building permit for an applicable project is issued. The proceeds from the fee are set aside in a designated fund and can only be used for improvement projects that add vehicle capacity to the City’s roadway network. Article XI, Chapter 14, Section 197 of the Municipal Code permits the Brentwood Board of Commissioners to adjust the required fees annually using the Construction Cost Index, developed by the Engineering-News Record to account of construction cost inflation. The fees are to be evaluated by staff and presented for review and approval by the Board of Commissioners, via resolution before December 1st of each applicable year. The new fees would become effective on January 1st following each year in which the fees were not comprehensively updated based on a new impact fee study. The first year of adjustment was 2021. The existing fees were multiplied by the ratio of the engineering news-record construction cost index for the most recent month for which the index is available, to the index for the same month of the previous year.
In September 2024, the Board of Commissioners voted to approve Resolution 2024-104, which increased the PWPF required for new projects a total of 1.08% from last year's Resolution.
